So, if you’re facing disorderly conduct or public disturbance charges or related hearings, you have to help the courts know the full story of your life, so you are not defined only by your charges!
Remember—in our legal system, you are innocent until proven guilty.
Even if the charges are upheld, or you plead guilty or no contest, you still deserve the best chance for a fair and balanced outcome, for example, a ruling that may emphasize rehabilitation, not just punishment.
Why?
Regardless of how “minor,” disorderly conduct or public disturbance charges, might appear, they are sometimes connected with serious mental health challenges like alcohol use, PTSD, hallucinations, or impulse-control of which the charged behavior might be a mere manifestation of the disease.
But please note three things:
1: Clients in detention: Conducting a comprehensive psychiatric evaluation requires the client’s full and active participation across multiple interviews and activities. These assessments involve a wide range of tasks that are not only time-consuming but also require privacy, flexibility, phone and internet access, and access to the client in a manner that is simply not possible within a custodial setting.
When a defendant remains in detention, logistical and procedural barriers—such as restricted access, limited time for interaction, and the absence of an appropriate therapeutic environment—make it virtually impossible to conduct a thorough and reliable evaluation. For this reason, unless the individual is residing in the community (for example, if bail has been granted), it is not feasible to conduct the extensive tasks that a proper psychiatric evaluation demands.
2: Objective reports: Our evaluation processes and conclusions are evidence-based and are usually supported by the highest scientific and professional standards. They are not about inventing excuses. Rather, we carefully uncover genuine, often overlooked, psychological factors that can shape understanding of your case. If our assessment does not suggest any underlying mental health factors, we'll state this in our report.
The ultimate decision to submit our report to the court or hearing would be yours and/or your attorney's alone.
However, one thing is certain: taking responsibility and demonstrating genuine empathy are essential to healing, and the legal system and society value them greatly. Proper evaluation can help. We ensure your voice is heard by presenting an accurate, evidence-based account of your mental health.
